Appellant and his co-defendant were jointly indicted and charged in two counts with the offenses of having in their possession and of transporting 1½ gallons of moonshine whiskey in violation of 26 U.S.C. § 5205 (a) (2). The codefendant pleaded guilty to both counts and was sentenced. He has not appealed.
