WARD, Justice.

Billy C. Hall (appellant) was charged with Grand Larceny for stealing a 1957 Dodge automobile (the property of Gay-lon Ellis) of the value of more than $35. A jury trial resulted in a conviction and his punishment was fixed at one year in the penitentiary.

On appeal, appellant urges five separate assignments of error which we will discuss in the order they are argued.
