MASON, Justice.

Plaintiffs' action at law, based upon fraud and breach of fiduciary relationship by defendant in the sale of certain real estate owned by plaintiffs, seeks actual and punitive damages. Trial to a jury resulted in a verdict against defendant for $1700 actual and $2500 punitive damages.

Defendant's motions for judgment notwithstanding the verdict and for a new trial being overruled, he appeals.
