This case arises out of a rear end accident which occurred during the evening rush hour in the inside lane of a controlled access freeway in Dallas, Texas. It was brought about when traffic traveling at 60 miles per hour was suddenly stopped in an inside lane when a vehicle ran out of gas and stalled in that lane.
