NELSON, Justice.

Defendant appeals from a judgment of conviction of aggravated assault entered by the district court on a plea of guilty.

It appears that on June 27, 1964, the defendant was confronted by a local police officer, Howard Gludt, in Lake City, Minnesota, during the early hours of the morning.
