This negligence case arises out of a fatal accident in the City of Philadelphia. It is within federal jurisdiction solely because of diversity of citizenship. The plaintiff's claims are asserted under the Pennsylvania Wrongful Death and Survival Acts, and the legal issues upon which this appeal turns are questions of Pennsylvania law.
