This is an action in tort arising out of an automobile accident which occurred on August 7, 1962, on Plank Road near the intersection of Mohican Street in the Parish of East Baton Rouge, Louisiana. The plaintiff, Mrs. Beatrice M. Martin, was a passenger in an automobile driven by Robert G. McDowell, Jr., when the McDowell automobile was struck from the rear by an automobile owned by Alvin B. Marson, Sr. and being operated by Alvin B. Marson, Jr....
