The parties will hereinafter be referred to as they appeared in the trial court; that is, Carl Fultz as the plaintiff, and Union Carbide Corporation as the defendant.

This is an appeal from a declaratory judgment rendered in favor of the defendant by the Circuit Court of Knox County, Tennessee.
