This case involves the written lease of a commercial building. The lessor, Gano D. Lemoine, sued the lessee, Dewey Devillier, for (1) cancellation of the lease and (2) rent during the unexpired term. The defendant lessee answered, acquiescing in the cancellation of the lease, but urged as a special defense eviction from a portion of the property.
