DALTON, District Judge.

On August 23, 1966, this court, upon prior consideration of the case, ordered that a hearing be held in the matter of petitioner's habeas corpus proceeding. Petitioner now presents this court with a trial brief urging that the hearing be waived and a writ of habeas corpus issue immediately.
