Appellants bring this appeal from an order of the probate court construing the provisions of the will of Nicholas S. Pitakos. The basic conflict is between appellant Charles M. Michel and the residuary legatees under the will. The will provision giving rise to this conflict reads as follows:

"ITEM THREE: I have previously made arrangements with my deceased wife's Nephew, CHARLES M. MICHEL, 2449 Bushwik Drive, Dayton, Ohio, whereby he has agreed...
