WEBBER, Justice.

The Augusta Water District, a corporation specially chartered by the Legislature, seeks to have the Public Utilities Commission determine its necessity to take land of the defendants by eminent domain. Its petition is brought pursuant to 35 M.R.S.A. Sec. 3294. The District proposes to erect an appropriate facility on the land so condemned in which to install and maintain a pump on an existing intake leading from Lake Cobbosseecontee to a pumping station...
