ALLOY, J.

Robert G. Brown, Defendant, appealed to the Supreme Court of this State from a conviction and sentence for the crime of embezzlement. The cause was transferred to this court by the Supreme Court.

Defendant was indicted on September 18, 1961, by the Grand Jury for the crime of Embezzlement by a public officer. He was found guilty by a jury and was sentenced to a term of two to five years in the State penitentiary. The indictment was in five counts...
