This action for damages against a union for breach of its duty of fair representation came before this court initially on review of a directed verdict in favor of the defendant union, granted at the close of the plaintiff's case. In that posture, after reviewing the complaint and the plaintiff's evidence, we concluded that the plaintiff had stated a cause of action.
