Appellants were defendants below and appellee was plaintiff. This was an action for damages arising out of injuries sustained in a collision between a tractor-trailer of the defendant J.J. Kelly, Inc. and an auto driven by the plaintiff. A jury trial was had and a verdict rendered for $5,000.00 in favor of the plaintiff. A motion for new trial was made by the plaintiff on the grounds, inter alia:
