Murder is the offense; the punishment, thirty-three years.

Trial was had and notice of appeal given prior to January 1, 1966.

The state's testimony shows that on the night in question appellant and the deceased first met at a drive-in in the city of Dallas. While at the drive-in they had a conversation about a girl, Linda Minyard, who was employed at the place. At about 12:15 a. m., the deceased left with Linda...
