SMITH, Justice.

The plaintiff, Harold Baldwin, Sr., was injured, and the truck owned and operated by him was demolished, as the result of a collision on February 12, 1964 between a locomotive owned and operated by the defendant, Vermont Railways, Inc. and the truck of the plaintiff. A tort action brought by the plaintiffs against the defendants resulted in a directed verdict for the defendant, State of Vermont, and a jury verdict for the plaintiff against the defendant...
