In this action for wrongful death the appellee recovered judgment for $70,000. The appellant filed its notice of appeal, but the record was refused by the clerk of this court, who thought that the notice of appeal had been filed too late. Under Supreme Court Rule 5 the appellant filed the present motion for a rule to require the clerk to docket the case. The motion involves a new procedural statute, which we have not had occasion to construe...
