Chase, instituted this action in tort claiming damages for personal injuries and incidental expense sustained and incurred when, as a bystander, he was struck by a can of flaming gasoline tossed aside by an unidentified party attempting to start a stalled automobile by pouring gasoline from a can into the vehicle's carburetor.
