The plaintiffs brought this class action to require the defendant to permit Negroes to play golf on a commercial course, which is open to all members of the public except Negroes.

The plaintiffs claim relief under Title II of the Civil Rights Act of 1964 relating to public accommodations, 42 U.S.C. § 2000a et seq. No question of the constitutionality of the Act has been raised. The case turns...
