Appellant had pled not guilty to a charge of violating D. C. Code § 22-2204, unauthorized use of a motor vehicle, punishable by a fine not exceeding $1,000 or imprisonment not exceeding five years, or both. At the conclusion of the Government's case in chief a plea to the lesser offense of taking property without right, carrying a maximum sentence of six months or a fine of $100.00, or both, D.C.
