The instant controversy involves the question as to whether Dwight D. Murphey, hereinafter referred to as the petitioner, has the right to have his name appear on the ballot at the forthcoming primary election as a designee of the Republican party for nomination for the office of district judge of the Fourth Judicial District of Colorado.
