Appellant was jointly indicted with Patrick Thaxton for possessing seventeen cases of one gallon glass jugs with the intention of using them in the non-tax paid distilled spirits business in violation of 26 U.S.C.A. § 5686(a). Thaxton pleaded guilty. Appellant went to trial before a jury on his plea of not guilty. Appellant moved for a judgment of acquittal at the close of the government's case and at the conclusion of the trial...
