Defendant was charged by county attorney's information with the crime of larceny in the nighttime from within a private building of chattels and money exceeding $20 in value in violation of section 709.4, Code, 1962. He pleaded not guilty, was tried before court and jury, found guilty as charged, sentenced to an indeterminate term not exceeding ten years in the State Penitentiary at Fort Madison and ordered to pay the costs.
