The defendant is the owner of real estate on Ash Street, Brockton, which was the subject of an agreement to sell to the plaintiff, a real estate promoter. Before papers were passed the city took the land by eminent domain. This bill in equity seeks to preserve the plaintiff's rights under the agreement.

The bill of complaint was entitled "plaintiff's bill for specific performance." Among the prayers was one for an injunction against the defendant...
