This is an appeal from a conviction of three counts of manslaughter in the driving of a motor vehicle while in the commission of an unlawful act not amounting to a felony with gross negligence. The criminal charges were the result of a one-car accident occurring on December 2, 1962, in Santa Cruz County, in the early hours of the morning as a result of which three passengers in the motor vehicle were killed.
