This action is brought under the Federal Tort Claims Act which gives this court jurisdiction.

The action arises out of an automobile accident occurring on May 29, 1961 at about 4:43 P.M. at the intersection of Highway 59 and Sunset Drive, Waukesha County, in the Eastern District of Wisconsin.
