MR. JUSTICE DEMPSEY delivered the opinion of the court.

Two indictments were returned against Juan Tolentino and Robert Medino. One charged them with the robbery of Robert P. O'Connor, the other with the robbery of John R. Logan. They entered pleas of not guilty and waived trial by jury. The indictments were tried together. The trial court found them not guilty of either robbery but found them guilty of "the lesser included offense of theft" of the property of O'Connor...
