PER CURIAM.

Defendant was indicted for the crime of Shoplifting in violation of section 709.20, Code, 1962, I.C.A., in that he took four men's suits from a store in Council Bluffs with the intention of converting them without paying the price thereof. He pleaded not guilty, was tried before court and jury, found guilty of taking merchandise of the value of $245, and sentenced to be confined in the county jail for a period of 60 days.
