Petitioner, Willie Lee Thomas, was charged in the Louisiana state court with simple battery, a misdemeanor under state law. After appearing in court with his attorney on August 6, 1963, he was sentenced to two years in the parish jail. The sentence was suspended and he was placed on two years active probation.
