Bruce Littlejohn, presiding in the court of common pleas for Darlington County, rendered judgment for the plaintiff on May 25, 1964; and from that judgment the defendant gave notice of intention to appeal to this court. Pending settlement of the record in that appeal, the defendant moved before the Honorable James
