Freeman Stewart, appellant herein, was charged with unlawfully possessing intoxicating liquors or beverages for sale in a dry county, the Information alleging Stewart to be a third offender, and therefore, guilty of a felony.1 On trial, the jury found Stewart guilty, and fixed his punishment at imprisonment in the State Penitentiary for five years.2<...
