MR. JUSTICE DEMPSEY delivered the opinion of the court.

Harry Smith was indicted for attempted murder and after a nonjury trial was found guilty and sentenced to a term of one to fifteen years in the penitentiary.

On the evening of March 28, 1963, Barbara Ehrenfeld was walking toward her home in Flossmoor, Illinois. Hearing footsteps behind her, she turned around and saw a person whom she later could describe only as a white man, 5 feet 10 or 11 inches tall...
