This is an appeal from an order denying defendant's petition for a writ of habeas corpus.

Defendant was married on December 9, 1951. Three children were born as a result of this marriage. In 1955, while he was serving a sentence in the state reformatory at St. Cloud, his wife obtained a divorce from him in which the care, custody, and control of the three minor children were awarded to her.
