Plaintiff in error, hereinafter referred to as defendant as he appeared in the trial court, was arrested October 11, 1963, for the crime of murder. November 15, 1963 defendant had a preliminary examination and was bound over for trial in the district court of McCurtain County. His trial commenced on June 30, 1964, and on July 3, 1964 the jury returned a verdict of guilty and assessed punishment at life imprisonment...
