EAGER, Judge.

Plaintiff sued for personal injuries sustained when he, as a pedestrian, was struck by defendant's car. There was a nine-man verdict for defendant and, after plaintiff's motion for a new trial was overruled, he appealed. The prayer of his petition was for $40,000 and he sustained substantial injuries, so we have jurisdiction.
