MURRAY, Judge.

This is a criminal case. The defendant was charged with the crime of uttering a forged instrument. The information reads in part as follows:

"Lucas Berger did with intent to defraud, utter and publish as true, a forged instrument, which instrument the said Lucas Berger knew was forged, to-wit: did utter and publish as true a check written on the Hartford Insurance Group in the sum of $66.50 and payable...
