On the night of February 17, 1961 a fire occurred at defendant's super market at 839 42nd Street in Des Moines. This is an action at law on a subrogation claim for fire and smoke damage resulting to plaintiff's insured, a tenant in the same building. The trial court found the fire was caused by defendant's negligence in failing to put out matches and cigarettes as alleged by plaintiff and entered judgment...
