The petitioner, on April 8, 1939, entered a plea of not guilty to an indictment charging him with murder in the first degree. He was at all times represented by competent counsel. Thereafter, on April 22, 1939, he requested permission to change his plea. Permission was granted, and he pleaded guilty to murder in the second degree.
