Appellant Ruiz was convicted by a jury and sentenced for the violation of the Marihuana Act.1 The conviction was established upon two counts of possession of marihuana under Section 4744(a)2 and two counts of transfer of marihuana under Section 4742(a)3 of Title 26 of the United States Code.
