This is an appeal from a judgment in the sum of $1,500.00 in favor of appellee, Robert C. Wood, for damages to his land and use of water from an artificial stock pond. Appellee owns a 160-acre stock farm near Cecil, Arkansas. On June 11, 1955 appellee executed an oil and gas lease on this tract of land to W. R.
