OPINION

CHAVEZ, Justice

Plaintiff-appellant appeals from the trial court's order withdrawing the case from the jury and dismissing the case with prejudice, on the grounds that appellant failed to establish a prima facie case of negligence on the part of appellee, and that appellant was guilty of contributory negligence as a matter of law. The trial court's order was, in effect, a directed verdict.
