This is an appeal from a judgment for the defendant based on a jury verdict. The plaintiff, Donald B. Burns, is a surveyor who was struck by defendant's automobile while he was working. The plaintiff will hereafter be referred to in this opinion as appellant, and the defendant will be referred to as respondent.
