On October 18, 1965 the trial court overruled appellant's motion for new trial. A petition for extension of time within which to file transcript and assignment of errors was filed in the office of the Clerk of this Court January 3, 1966 but it was accompanied by no proof that appellee or his counsel had notice of such request for time.
