On August 2, 1961, K.L. Hancock of Raleigh, Smith County, Mississippi, acting by and through his brother-in-law, J.W. Ashley, Jr., purchased a used 1959 model truck-tractor from Mack Trucks, Inc., in Tampa, Florida. The conditional sales agreement was signed "K.L. Hancock" as vendee with no indication that J.W.
