JERTBERG, Circuit Judge:

Following trial to a jury appellant was convicted on both counts of a two count indictment charging violations of 21 U.S.C. § 176a, and 19 U.S.C. §§ 1459, 1461, 1484 and 1485.

The first count charged that appellant and one Curry, and one Gutierrez, with intent to defraud the United States, knowingly smuggled and clandestinely introduced into the United States from Mexico, approximately 12 pounds of marijuana, which marijuana...
