The defendant, Maurice Pendleton, was found guilty of theft in a nonjury trial and was sentenced to serve a term of two to five years in the penitentiary.

The defendant contends that the State failed to prove that a theft was committed; that if a theft was committed the State did not prove the identity of the person who committed it; and that the State did not prove beyond a reasonable doubt that he participated...
