This action was instituted by a 2-year-old boy as plaintiff (by his mother as guardian ad litem) against his host for personal injuries sustained while he and his mother were invited guests in his home.

In the complaint, it was alleged that the host, while the plaintiff was within his residence, "carelessly and negligently caused, permitted, and allowed said minor plaintiff to be injured." The injuries thus sustained were alleged to be severe...
