CHRISTIE, District Judge:

The defendant was indicted for violating the Universal Military Training and Service Act, 50 U.S.C.A. App. §§ 451-473, by refusing to perform civilian work prescribed by the Act for conscientious objectors. He entered a plea of "not guilty" and the case proceeded to trial by the Court, a jury being waived. At the close of all the evidence, the defendant moved for a judgment of acquittal on the ground that certain procedural rights...
