This is an appeal from an order granting summary judgment and dismissing the appellant's complaint for failure to state a cause of action.

This action has been brought by Annemarie Scheffler as administratrix of the estate of her deceased son, Ralph. The complaint alleged that on July 26, 1957 Ralph, then being three and one-half years old, fell through the screen in a window of a third floor...
